These Terms of Use govern the general terms applicable to access and use of the website of ARIONKODER  https://www.arionkoder.com (hereinafter, the ‘Site’). 

Any person who accesses the Site and registers as a user of the Site (hereinafter, the “User”) shall be subject to these Terms of Use. This includes visits to the Site as well as any sale or transaction or request for information regarding ARIONKODER or any product or service provided by ARIONKODER. Any person who does not accept these binding Terms of Use shall refrain from using the Site.

The use of the Site, its services or content implies full and unreserved acceptance of all the provisions contained in the version published at the time the User accesses the Site. ARIONKODER reserves the right to amend these Terms of Use whenever it deems appropriate, without cause and without any liability. Given that the Terms may be modified at any time by ARIONKODER, User is advised to read them carefully each time it intends to use the Site. New versions shall come into effect from the moment they are published on the Site.

1. USER REGISTRATION ON THE SITE

For the purposes of using the Site, there are two types of Users:

1. Any individual, legal entity, or public entity, whether state-owned or not, that uses the information provided on the Site directly or through a computer application.

2. Any individual, legal entity, or public entity, whether state-owned or not, that accesses the site to browse, learn about, and obtain information.

2. CONDITIONS OF ACCESS AND USE OF THE SITE

Use of the Site is free of charge for the User, who undertakes to use it in accordance with current regulations, good customs and public order, undertaking in all cases not to cause damage to ARIONKODER, to another user or to third parties.

Accordingly, User shall refrain from using the Site, its contents or any of its services for purposes or effects that are unlawful, prohibited in these Terms of Use, in technical or legal regulations, harmful to the rights and interest, other users or third parties, or that in any way may damage, disable, overload, deteriorate or impede the normal use of the Site, its services or contents, as well as any computer equipment belonging to ARIONKODER other users or third parties.

Unless otherwise indicated, the information contained in the Site shall be considered public. When its use or processing is subject to any type of restriction, the provisions expressly indicated in that case shall apply.

3. PERSONAL DATA PROTECTION

The personal data provided by the User when registering on the Site and using the Services will be handled responsibly and in accordance with applicable data protection standards.

The User acknowledges that ‘cookies’ are used on the Site. However, the User may configure the browser to be notified of the receipt of such ‘cookies’ and prevent their installation on the hard drive, if deemed appropriate.

4. USER OBLIGATIONS

The User undertakes to comply with the following obligations, which include but are not limited to the ones listed below:

5. Not to use any content, materials, or information obtained through the Site solely for personal and legitimate purposes, and not for commercial exploitation unless prior written authorization is granted by ARIONKODER.

ARIONKODER shall take action against any use of the site by the User who does not agree with the established terms and/or infringes or violates the intellectual and industrial property rights or other similar rights of ARIONKODER.

ARIONKODER reserves the right to amend, at any time and without prior notice, the presentation, configuration of the Site, and the content and services included therein. It may also interrupt, deactivate and/or cancel any of the content and/or services included therein.

5. INTELLECTUAL PROPERTY

All content, information, data, graphic texts, images, photographs, audio and video clips, logos, icons, programmes, databases, networks, trademarks, trade names, distinctive signs, and files that allow the User to access and use their account are the property of ARIONKODERwithout it being understood that the use of or access to the Site gives the User any rights over the aforementioned trademarks, trade names or distinctive signs of any kind, all of which are protected by law.

The misuse and total or partial reproduction of such content is prohibited, unless expressly authorised in writing by ARIONKODER. 

6. LINKS TO OTHER WEBSITES

The Site may contain technical linking devices (such as links, banners, buttons) that allow access to websites belonging to third parties, with the sole purpose of facilitating the User's search and access to other sites and/or content available on the Internet. 

Links to other websites, services or content do not imply approval in any way by ARIONKODER, which therefore shall not be held contractually, legally or otherwise liable for the information provided by other websites and the consequences thereof. The presence of links to other websites does not imply a partnership, relationship, approval or endorsement by ARIONKODER of such sites and their content.

7. DISCLAIMER OF WARRANTIES

THE USER ACKNOWLEDGES AND AGREES THAT:

(A) THE USER ASSUMES ALL RISKS RELATED TO, OR ARISING FROM, THE USE, CONSULTATION OR ACCESS BY THE USER TO THE SITE. THE SITE IS PROVIDED ‘AS IS’ AND ‘AS AVAILABLE’, WITHOUT WARRANTY OF ANY KIND;

(B) TO THE EXTENT PERMITTED BY LAW, ARIONKODER HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES AND LIABILITIES, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO: THE IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THOSE USUAL IN THE TRADE OR IN THE NEGOTIATIONS IN THIS SECTOR; AND

(C) ALTHOUGH ARIONKODER HAS ANTI-VIRUS SYSTEMS AND TAKES SECURITY MEASURES TO PROTECT THE SITE AND ITS CONTENT FROM ALL TYPES OF COMPUTER ATTACKS TO REDUCE THE LEVEL OF RISK, ARIONKODER HEREBY EXPRESSLY DISCLAIMS ALL WARRANTIES WITH RESPECT TO: (I) THAT THE SITE AND ITS CONTENT WILL ALWAYS BE FREE OF ERRORS OR VIRUSES OR WILL NEVER SUFFER ATTACKS BY THIRD PARTIES; (II) THE UNINTERRUPTED AND ALWAYS SECURE OPERATION OF THE SITE; (III) THE PERMANENT AVAILABILITY OF THE SITE; (IV) THE SITE MEETING OR NOT MEETING THE USER'S NEEDS; AND (V) THE RELIABILITY, ACCURACY, COMPLETENESS, VALIDITY OR TRUTH OF THE INFORMATION PROVIDED BY THE USER.

8. LIMITATION OF LIABILITY. INDEMNITY

THE USER ALSO AGREES TO HOLD ARIONKODER, ITS PARENT COMPANY AND ITS SUBSIDIARIES AND AFFILIATES, AS WELL AS THEIR EXECUTIVES, MANAGERS, SALES REPRESENTATIVES AND EMPLOYEES, FROM ANY CLAIMS, LAWSUITS OR CLAIMS FOR COMPENSATION FOR DAMAGES (DIRECT, INDIRECT AND CONSEQUENTIAL) OF ANY KIND, KNOWN OR UNKNOWN, THAT MAY BE BROUGHT ON THE BASIS OF, OR ARISING FROM THE USE OF THE SITE.  THE INFORMATION PROVIDED BY THE USER OR THE TRANSACTIONS THAT OCCUR AS A RESULT OF THE USE OF THE SITE BY THE USER. ALWAYS WITHIN THE LEGAL LIMITS, THE USER ASSUMES AND ACCEPTS THAT IN NO EVENT SHALL ARIONKODER OR ITS PARENT COMPANY, ITS SUBSIDIARIES AND AFFILIATES, NOR ITS EXECUTIVES, SALES REPRESENTATIVES, EMPLOYEES OR SUPPLIERS OF ANY OF THEM, SHALL BE LIABLE FOR ANY DIRECT, INDIRECT OR CONSEQUENTIAL LOSSES OR DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROPERTY DAMAGE AND PURELY ECONOMIC DAMAGES), NOR FOR LOSS OF PROFITS, LOSS OF CUSTOMERS, LOSS OF REVENUE OR DATA, OR INTERRUPTION OF USE, REGARDLESS OF THE CAUSE THAT MAY HAVE GIVEN RISE TO THEM - BREACH OF CONTRACT, NEGLIGENCE OR BREACH OF WARRANTY, EVEN IF ARIONKODER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGE. ARIONKODER 'S CUMULATIVE LIABILITY SHALL NOT EXCEED THE TOTAL AMOUNT OF EACH SERVICE CONTRACTED BY THE USER.

9. TERMINATION

ARIONKODER may, at its sole discretion, terminate the Services offered on the Site and remove any content from it, as well as suspend the Site when it believes that the conditions for its continuity are not met.
